Terms of Service

1. Acceptance of these terms

Banded is the social gig diary, an iOS app and related services operated from the United Kingdom (the "Service"). By creating an account, signing in, or using the Service you agree to these Terms of Service (the "Terms"). If you don't agree, please don't use the Service.

These Terms work alongside our Privacy Policy, which explains how we handle your personal data.

2. Eligibility

You need to be at least 13 years old to use Banded. You must also have the legal capacity to enter into a binding contract in your jurisdiction. Where parental or guardian consent is required by applicable law, you may use the Service with their permission.

If you're using Banded on behalf of an organisation, you confirm you have the authority to bind that organisation to these Terms.

3. Your account

• You are responsible for keeping your sign-in credentials secure. Where you use Sign in with Apple, account credential security is governed by Apple's policies — however, you remain responsible for all activity on your Banded account.
• One account per person. Don't impersonate someone else, claim to be a band you're not in, or pretend to be Banded staff.
• You're responsible for all activity that happens through your account. If you think someone else has accessed your account, email [email protected] straight away.
• We may reclaim usernames that infringe trademarks, impersonate well-known artists or venues, or have been inactive for an extended period.

4. Your content

"Your Content" means everything you put into Banded — gig logs, ratings, reviews, comments, profile information (including any avatar or banner you upload), top-four picks, and any other material you submit to the Service.

• You own your content. Banded does not claim ownership of anything you post.
• Licence to Banded. By posting Your Content, you grant Banded a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute it within the Service, and — for content you set to public — to display it on share cards and in places where you choose to share it (e.g. Instagram Stories). This licence exists only to let us run the Service.
• You're responsible for what you post. Only upload images (profile avatar or, for Pro and Backstage subscribers, your profile banner) that you have the right to use. Don't upload anything that infringes someone else's copyright, trademark, or privacy.
• You can delete your content at any time by deleting the gig log, comment, or image, or by deleting your whole account in Profile → Settings → Account.

5. Acceptable use

The following conduct is prohibited on Banded:

• Harass, threaten, dox, bully, or stalk anyone — on a profile, in a review, in comments, or anywhere else.
• Post content that is hateful, discriminatory, sexually explicit, or otherwise illegal in the UK.
• Spam other users, send unsolicited promotional messages, or fill the feed with low-effort content.
• Fake gigs, manipulate ratings, run multiple accounts to inflate stats, or otherwise game the diary.
• Scrape, crawl, reverse-engineer, decompile, or otherwise extract data from Banded, except via features the app explicitly offers.
• Use Banded for any commercial purpose without our prior written permission.
• Try to disrupt or compromise the Service — no probing for vulnerabilities, denial-of-service attempts, or attempting to access other users' accounts.
• Upload concert audio or video recordings that infringe artist or venue rights.

We may remove content or suspend accounts that breach these rules, with or without notice depending on severity.

6. Banded Pro and Banded Backstage

Banded offers paid tiers — currently Banded Pro and Banded Backstage — which unlock features such as custom profile accents, custom banners, year-in-review extras, and (for Backstage) directory listing. Free accounts always retain access to their own gig diary.

• Billing. Subscriptions are sold and billed by Apple via the App Store. We don't see your card details. Pricing is shown in the app before you confirm a purchase.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. To cancel, go to iPhone Settings → your name (Apple ID) → Subscriptions → Banded → Cancel Subscription. Your paid features remain active until the end of the period you've already paid for.
• Refunds. Refunds are handled by Apple under their App Store refund policy. We can't process refunds directly.
• Changes to features. We may add to or change the features in each tier over time. If we materially reduce what's included in a paid tier, we'll let you know in-app and give you a fair chance to cancel.
• Promotional offers (free trials, introductory pricing) follow Apple's standard rules and any specific terms shown when you redeem the offer.

7. Third-party data and links

Artist information, event listings, and images come from third-party sources — see our Data page for the full list. Banded provides this information "as is" and is not responsible for its accuracy. If you find an error, email [email protected] and we will investigate.

Ticket purchase links open external sites (Ticketmaster and others). Any transaction you make there is between you and the ticket vendor; Banded isn't a party to it and doesn't earn affiliate revenue from those links unless explicitly disclosed.

8. Banded's intellectual property

The Banded name, logo, ticket-stub design, original UI, share-card designs, and the look-and-feel of the app are owned by Banded and protected by intellectual property laws. You can't reproduce, modify, or use them outside of the app without our written permission, except where fair use or fair dealing applies.

This does not restrict you from screenshotting or sharing your own gig diary content or share cards.

9. Suspension and termination

You can stop using Banded at any time and delete your account in Profile → Settings → Account → Delete Account. Deletion is permanent.

We may suspend or terminate your account if we believe you've materially breached these Terms or applicable law, or if we're required to by law or by an order from a competent authority. Where reasonable, we'll give notice and a chance to fix things first.

Sections 4 (the licence you grant for content already shared), 8, 10, 11, and 12 survive termination.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, Banded makes no representations or warranties of any kind, express or implied, in respect of the Service — including, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy of third-party data, or uninterrupted or error-free availability.

Certain content displayed in Banded — including upcoming event listings, setlists, and artist images — is sourced from third-party APIs and is subject to change, interruption, or inaccuracy. Banded endeavours to maintain the accuracy of such information but cannot warrant its completeness or currency.

11. Limitation of liability

Nothing in these Terms excludes or limits Banded's liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that can't be excluded under UK law. You also retain your statutory rights as a consumer.

Subject to that:

• We aren't liable for indirect or consequential losses, lost profits, lost data, or loss of business opportunity.
• Our total aggregate liability to you under or in connection with these Terms is capped at the greater of (a) the amount you've paid Banded for subscriptions in the 12 months before the claim arose, or (b) £100.

12. Governing law and jurisdiction

These Terms and any dispute arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you're a consumer resident elsewhere in the UK or EU, you can also bring proceedings in the courts of where you live, and the mandatory consumer-protection laws of where you live still apply.

13. Changes to these terms

We may update these Terms from time to time — for example, to reflect new features, legal requirements, or services we add. If we make material changes we'll let you know in-app and update the "Last updated" date at the top of this page. Continuing to use Banded after a material change means you accept the updated Terms; if you don't, please stop using the Service and delete your account.
